License Agreement

CGMALL LICENSE AGREEMENT

Read these terms carefully before purchasing or using any 3D assets ("3D Asset Collections") from CGMALL, operated by Crafthive ("Licensor"). By purchasing or using assets from CGMALL, you ("Licensee") agree to be bound by this License Agreement ("Agreement"). If you do not agree to these terms, do not use or purchase assets from CGMALL.

 

1. DEFINITIONS

  • "3D Asset Collection" refers to any 3D model, VDB, texture, material, or kit available for purchase or download from CGMALL.
  • "Licensee" means the individual or company purchasing and/or using the 3D Asset Collection.
  • "Licensor" refers to Crafthive Creative Inc., the creator and owner of the 3D Asset Collections.

 

2. OWNERSHIP & COPYRIGHT

All 3D Asset Collections are the exclusive intellectual property of Crafthive Creative Inc. This Agreement grants usage rights only; it does not transfer ownership or copyright. Crafthive retains full intellectual property rights, including but not limited to copyrights and distribution rights.

 

3. LICENSE RIGHTS

Upon purchase, Licensee is granted a non-exclusive, non-transferable, non-sublicensable right to use the 3D Asset Collection in accordance with the selected license tier and the permitted uses outlined below.

 

4. LICENSE TYPES

IMPORTANT: You must select the appropriate license based on your team size and usage needs. Misuse of a license tier is a breach of this Agreement and may result in license revocation.

4.1 PERSONAL LICENSE (Individual/Freelancer)

  • For individuals or freelancers working alone.
  • May be used in personal or commercial projects.
  • License is for one user only and cannot be used by multiple people within a studio or team, even if only one person is using the assets.

4.2 INDIE LICENSE (1–5 users)

  • For small teams or studios of up to 5 active users.
  • May be stored on a team server accessible by up to 5 team members.
  • Permitted for commercial use, including games, films, apps, and other client or studio projects.

4.3 STUDIO LICENSE (6+ users)

  • For larger teams and studios with more than 5 users.
  • May be shared internally within the purchasing organization.
  • Allows use in professional and commercial projects of any scale.

 

5. RESTRICTIONS

Regardless of license type, you may NOT:

  • Resell, redistribute, sublicense, or share any asset in its original or modified form.
  • Include assets as standalone or extractable content in any digital product (e.g., asset packs, templates).
  • Use assets in any way that enables third parties to access or download them directly.
  • Transfer your license to subcontractors or external studios without purchasing a separate license.

  • Claim the assets as your own intellectual property.

 

6. LICENSE TERM & TERMINATION

  • Licenses are perpetual and apply to the assets as downloaded at the time of purchase.
  • If Licensee violates any term of this Agreement, the license may be immediately revoked.
  • If the license is revoked, the Licensee must delete all copies of the asset(s), both physical and digital.

 

7. REFUNDS

Refunds will only be issued under the following conditions:

  • The asset does not match the technical specifications described at time of purchase.
  • A mistaken purchase is reported and exchanged for another product of equal or lesser value.

Refunds will not be issued for misuse, license confusion, or download issues caused by user error.

 

8. WARRANTY & LIABILITY

Crafthive Creative Inc. does its best to ensure asset quality. If there are missing files or critical errors, we will provide replacements or fixes upon valid request.

Assets are provided “as-is” without warranty of any kind. The Licensor shall not be liable for any damages arising from the use or inability to use the assets.

 

9. MAINTENANCE & SUPPORT

No technical support or maintenance is guaranteed unless otherwise stated in writing.

 

10. INTELLECTUAL PROPERTY RIGHTS

Crafthive Creative Inc. retains all rights, title, and interest in all 3D Asset Collections. Nothing in this Agreement shall transfer any intellectual property rights to the Licensee.

Unauthorized use may constitute a violation of applicable copyright laws and international treaties.

 

11. GOVERNING LAW

This Agreement shall be governed and construed in accordance with the laws of the Province of Quebec, Canada. The parties agree to submit to the exclusive jurisdiction of the courts in that region for any dispute related to this Agreement.
